“The status hearing is set for 10:30 a.m.” (ABC 7). The hearing is for the brother’s bid for freedom, following the LA District Attorney’s call for resentencing the two convicted brothers.

The brothers were arrested and convicted of murder when the brothers “admitted they fatally shot” (ABC 7) their Parents, Jose & Kitty Menendez, when they were just 21 and 18, respectively.

During the first trial, the brothers “said they feared their parents were about to kill them to prevent the disclosure of the father’s longtime sexual molestation of Erik Menendez.”.., the prosecution would argue that the brothers “killed their parents for financial gain and contended that no such abuse occurred” (ABC 7).

For years, the brothers pleaded alongside many family members for their release. Last month, the brothers’ family held a press conference in Los Angeles to speak about the brothers possibly getting released as prosecutors began to review new evidence in the case.

Following the call for the resentencing, the brothers have waited for a long time for this moment, as they will look to fight for their freedom, with new evidence being presented that “proves what defense attorneys have been arguing all along, that the killings prove imperfect self-defense, which relies on the idea that they were genuinely afraid for their lives” (Los Angeles Magazine).

The jury will be selected through a lottery, in which 16 seats will be up for grabs outside the Van Nuys courthouse in Los Angeles. The actual resentencing is tentatively set for December 11, 2024.
